Bolen to Testify in Upcoming House Hearing
NBAA President and CEO Ed Bolen will testify at a Dec. 12 hearing before the House Transportation & Infrastructure Committee’s Aviation Subcommittee on "The State of American Aviation" in the year ahead. Other scheduled participants include the General Aviation Manufacturers Association and Airlines 4 America. Among the issues Bolen is expected to highlight is the state of the industry's continuing, though gradual, economic recovery and the upcoming challenges as another round of budget sequestration looms. Key House Committee Approves Bill on FAA Sleep Apnea Policy
The U.S. House Transportation & Infrastructure Committee approved legislation last week that would compel the FAA to follow established rulemaking processes before implementing a new requirement that some pilots be screened for obstructive sleep apnea (OSA) prior to receiving a medical certificate. The legislation, H.R. 3578, was introduced on Nov. 21 by Rep. Frank LoBiondo (R-2-NJ), chairman of the Committee's Aviation Subcommittee. The bill responds to a new policy that the agency would soon begin subjecting pilots with a body mass index of 40 or greater to OSA screening. "We thank the co-sponsors of H.R.3578, and all the members of the full committee, for their prompt, bipartisan action on this matter, and we look forward to prompt passage of the bill by the full House," said NBAA President and CEO Ed Bolen. NBAA Welcomes House Passage of Aviation Security Stakeholder Participation Act
NBAA welcomed recent passage in the U.S. House of Representatives of H.R.1204, the Aviation Security Stakeholder Participation Act of 2013, which would require the Transportation Security Administration (TSA) to permanently establish an Aviation Security Advisory Committee (ASAC), a government/industry group that collaborates on security policies. NBAA strongly supports the legislation as it will as it will codify the existing ASAC (on which NBAA participates), and requires the TSA to consult with the ASAC on aviation security matters. It also requires the ASAC to develop recommendations to improve aviation security when requested to do so by the TSA. Learn more about the bill .

Court Holds Aircraft Not 'Placed in Service' Until Completion of Post-Purchase Modifications
In a recent opinion, the U.S. Tax Court held that a new aircraft delivered in December 2003 was not "placed in service" for depreciation purposes until modifications were completed in 2004. The taxpayer lost its bonus depreciation deduction in 2003 and had to pay a 20 percent tax penalty. Based on testimony from the taxpayer, the court concluded that installation in 2004 of a conference table and video monitor in the aircraft was necessary for the aircraft to be fully ready to perform the specific function required by the taxpayer and thus be placed in service in 2004. This case may affect buyers of aircraft who have modifications to the aircraft performed in a subsequent year. Review the full opinion .

OpenAirplane Makes Renting Business Aircraft Easier
OpenAirplane is a Chicago-based company that combines the Internet, mobile apps and a growing network of aircraft providers to get more pilots into the air, regardless of where they are when they want to fly. Pilots can join OpenAirplane for free, but they must complete a universal pilot checkout (UPC). Designed to follow the FAA's Practical Test Standards, the UPC is administered to OpenAirplane pilots once every 12 months. Successful completion of the UPC enables pilots to rent aircraft at any one of the participating flight schools and FBOs. Currently, there are 30 participating aircraft providers in the continental U.S. and Alaska, and more than 4,000 pilots have joined OpenAirplane. Universal Weather and Aviation Has No Plane No Gain Message 'Pinned' Down
The 1,700 employees of Universal Weather and Aviation Inc. will soon be sporting No Plane No Gain lapel pins to demonstrate their support of business aviation, and to help educate the many aviation and government officials around the world with whom they work about the industry's value. Universal, which has more than 40 offices in 19 countries, will distribute an additional 1,300 pins to aviation and government officials around the world via its ground support locations, international trip support offices and UVair fuel offices. NBAA Advising Members to Check China ADIZ Flight-Planning Requirements
NBAA is advising Members with planned flights to China to review recent Notices to Airmen (NOTAMs), which address procedures for flying in that country's newly defined Air Defense Identification Zone (ADIZ). There are numerous such zones in existence around the word, including those promulgated by the United States. Chinese officials issued two recent NOTAMs (NOTAMR A1886/13 and NOTAM A1916/13)) about that country's ADIZ in conjunction with a Nov. 23 announcement of an intent to expand the zone to cover an area located over the East China Sea, approximately 100 miles due east of Shanghai. Missouri Study Highlights Value of Local Airports
The 2012 Missouri Statewide Airports Economic Impact Study determined that aviation pumps approximately $11.1 billion annually into the state's economy, a figure that represents 4.3 percent of Missouri's gross state product and a 17.1 increase over the past decade. Moreover, the study determined that business aviation was a key factor in that growth. "Business aviation fueled a large part of that growth, which came despite the economic downturn in recent years," said MoDOT Aviation Operations Manager Bryan Gregory. "By comparison, the amount of commercial airline activity in our state has remained largely the same since 2002." Read more about the economic impact of aviation in Missouri .

Flight Advisory Issued for Honolulu, HI During Holiday Season
The FAA has issued a flight advisory for the Honolulu, HI area for portions of the holiday period from the end of December 2013 through the beginning of January 2014. While the TFR has not yet been issued, and the specific times and location are unknown, the advisory indicates that the TFR will be a traditional 10/30 nautical mile TFR, with the "inner" 10 nautical mile ring being restrictive to general aviation aircraft. Kissimmee Gateway's Crosswind Runway to Close for Construction
The crosswind runway, 6/24, on Kissimmee Gateway Airport (ISM) south of Orlando, FL, will close on or about Jan. 2 for approximately 120 days. The runway will be undergoing major reconstruction is not expected to reopen until the work is completed. The main runway, 15/33, will remain open for normal operations. The OpenAirplane system is designed for pilots whose travel takes them to distant regions where they have a number of stops to make. If a pilot from Chicago has a number of business calls to make in Florida, that pilot could fly commercial to Orlando, then, using his or her OpenAirplane app, quickly locate an aircraft and engage it to fly to multiple destinations within the region.
